1. Introduction and Acceptance

1.1 Agreement to Terms

Welcome to Fiby, a personal finance tracking and organization application developed and owned by Accie Technologies. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Accie Technologies ("we," "us," or "our") governing your use of the Fiby mobile application (the "App") and related services.

1.2 Trademark and Ownership

"Fiby" is a trademark of Accie Technologies. Trademark registration (class: 9) has been filed and is pending approval. The Fiby name, logo, and all related intellectual property are the sole property of Accie Technologies. Unauthorized use, reproduction, or distribution of our trademark or intellectual property is strictly prohibited.

1.3 Amendments

We reserve the right to modify these Terms at any time. Material changes will be notified through the App or via email. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.

2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 18 years of age to use Fiby. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2.2 Account Types

Fiby may offer different account types:

• Guest or Anonymous Use: May be available with limited features and local-only data storage
• Registered Account (Google Sign-In or Email): Full-featured account with access to optional backup and additional features

Your Responsibility: You are responsible for maintaining the security of your account credentials, your Google account (if used for sign-in or backup), and any backup recovery codes provided by the app. You are responsible for all activities that occur under your account.

2.3 Account Responsibility

You are responsible for:

• Maintaining the confidentiality and security of your account credentials
• Maintaining the security of your Google account if used for authentication or backup
• Safeguarding any backup recovery codes shown by the app
• All activities that occur under your account
• Notifying us immediately of any unauthorized access to your account

3. Description of Services

3.1 Core Features

Fiby is a personal finance tracking, organization, reminder, and reporting application. The app provides:

• Transaction Tracking: Manual entry and optional automatic detection of financial transactions from notification data (if you grant notification access permission)
• Expense and Income Management: Organization and categorization of financial transactions
• Budgets and Goals: Tools to set and track financial budgets and goals
• Financial Reports and Insights: Reports, charts, trends, and spending analytics
• Reminders: Alerts for bills, subscriptions, and recurring payments
• Notes and Lists: Shopping lists and financial notes
• Data Export: Export your data in CSV or other supported formats
• Optional Google Drive Backup: Optional encrypted backup to your connected Google Drive account (see Section 3.2)

3.2 Google Drive Backup (Optional)

If you choose to enable the optional backup feature:

• Backup Storage: Backup files are uploaded to your connected Google Drive account, not to Fiby or Accie Technologies servers
• Encryption: Backup files are encrypted before upload
• Your Control: You control when backups are created, and you can disable or delete backups through the app settings
• Backup Recovery Code: Restoring a backup on another device may require a backup recovery code that was displayed when the backup was created. You are responsible for preserving this recovery code
• Google Account Dependency: Backup and restore features require connection to a Google account and are subject to Google Drive availability and your Google account status
• No Guarantee: While we strive to provide reliable backup functionality, we do not guarantee that backups will always succeed, that backup files will always be restorable, or that Google Drive will always be available

3.3 Service Limitations and Disclaimers

What Fiby Does: Fiby helps you track, organize, and visualize your personal financial information primarily on your device. Fiby is not a financial advisor and does not guarantee the accuracy of financial insights. Transaction detection from notifications (if you grant permission) is automated but may contain errors. You are solely responsible for verifying all financial information and for any financial decisions you make. You should consult qualified professionals for financial, investment, tax, or legal advice.

4. User Obligations and Conduct

4.1 Permitted Use

You may use Fiby only for lawful purposes and to track your personal financial transactions, generate reports, and set reminders.

4.2 Prohibited Conduct

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to hack, reverse engineer, or decompile the App
• Use automated systems or bots to access the App
• Interfere with or disrupt the App's operation or servers
• Transmit viruses, malware, or harmful code
• Impersonate another person or entity
• Use the App for commercial purposes without our written consent
• Remove or modify any copyright, trademark, or proprietary notices

4.3 Data Accuracy

While we strive for accurate transaction categorization, you acknowledge that automated categorization may contain errors. Fiby is not a financial advisor and does not guarantee the accuracy of financial insights. You are responsible for verifying the accuracy of your financial data and should not rely solely on Fiby for important financial decisions.

5. Permissions and Data Access

5.1 Required and Optional Permissions

Fiby may request the following device permissions:

• Internet Access: Required for user authentication, crash diagnostics, optional analytics, and optional Google Drive backup
• Notification Access (Optional): To read financial transaction notifications for automatic transaction detection and categorization
• Biometric/Device Credentials (Optional): For optional app-lock security (fingerprint, face recognition, or device PIN)
• Google Drive Access (Optional): For optional encrypted backup to your Google Drive account
• Alarm and Schedule Exact Alarm (Optional): For reminder and alert notifications

5.2 Notification Access (Optional)

Granting notification access permission is optional. If you choose to grant notification access:

• You authorize Fiby to read notifications from banking, payment, and financial apps
• Fiby will detect and extract transaction information (amount, merchant, date, account) from financial notifications
• Fiby will store the structured transaction data locally on your device for categorization, review, editing, and app functionality
• Notification processing runs primarily on your device
• If you enable optional Google Drive backup, backed-up app data may include transaction records detected from notifications

5.3 Data Privacy

Your data privacy and the data we process are governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read the Privacy Policy carefully to understand what data is collected, how it is used, where it is stored, and your rights and choices.

6. Intellectual Property Rights

6.1 Ownership

All content, features, and functionality of the App, including software code, algorithms, user interface, design, trademarks, and transaction categorization logic, are owned by Accie Technologies and protected by intellectual property laws.

6.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device for personal, non-commercial purposes.

6.3 Restrictions

You may not copy, modify, create derivative works, sell, rent, lease, distribute, or use the App to develop a competing product.

6.4 Trademark Protection

"Fiby" and associated logos are trademarks of Accie Technologies (trademark registration pending). You may not use our trademarks without our prior written consent. Any unauthorized use may result in legal action.

7. Fees, Pricing and Future Monetization

7.1 Current Pricing

At present, every feature in the Fiby application is provided free of charge. There is no paid tier, premium subscription, or in-app purchase available in the App as of the effective date of these Terms.

7.2 Future Monetization — Reservation of Rights

7.3 No Permanent Pricing Guarantee

Statements that the App or any feature is “free” describe the App as it exists today and do not constitute a permanent, irrevocable or perpetual commitment. We make no warranty, express or implied, that any feature will remain free of charge indefinitely. The current pricing model may be revised based on operational costs, regulatory changes, market conditions, or our business decisions.

7.4 Refunds

As the App does not currently charge any fees, there are no refunds to process. If and when paid features are introduced:

• Billing will be handled through the Google Play Store or another payment provider that we select
• Refund eligibility will be governed by the policies of the payment provider and the terms applicable to that paid feature at the time of purchase
• We may, at our sole discretion, offer goodwill refunds for service disruptions, but we are not obliged to do so

7.5 Notice of Material Changes

We will make commercially reasonable efforts to notify you of material changes to pricing or monetization by one or more of the following means: an in-App notice, an announcement on our website, or an email to your registered email address. The form, channel and timing of notice are at our discretion, subject to any minimum notice period required by applicable law.

8. Third-Party Services

8.1 Google and Firebase Services

Fiby integrates with the following Google and Firebase services:

• Firebase Authentication: For user sign-in and account management
• Firebase Crashlytics: For crash reporting and diagnostics
• Firebase Analytics: For optional usage analytics (disabled by default, opt-in only)
• Google Sign-In: For authentication via Google account
• Google Drive API: For optional encrypted backup storage in your Google Drive account

Your use of these services is governed by Google's Terms of Service and Google Privacy Policy. We are not responsible for Google's services, their availability, changes to their services, or their data handling practices.

8.2 Banking, Payment, and Financial Apps

If you grant notification access permission, Fiby may read notifications from third-party banking, payment, and financial services apps. These may include but are not limited to:

• Banking apps (e.g., HDFC Bank, ICICI Bank, SBI, Axis Bank, and others)
• Payment apps (e.g., Google Pay, PhonePe, Paytm, and others)
• Credit card issuers and financial institutions
• Investment and trading platforms

8.3 Third-Party Liability

We are not liable for:

• Issues, errors, or changes in third-party services (Google, Firebase, banking apps, etc.)
• Unavailability or interruption of third-party services
• Data loss or corruption caused by third-party services
• Changes to third-party terms, policies, or pricing
• Your relationship with or obligations to third parties

9. Disclaimers and Limitations of Liability

9.1 "AS IS" Disclaimer

Fiby is a financial tracking tool, not a financial advisor. Fiby does not guarantee the accuracy of financial insights. We do not provide investment advice, tax preparation services, legal or accounting services, or certified financial planning. You should consult qualified professionals for financial, tax, or legal advice.

9.3 No Guarantee of Accuracy or Availability

We do not guarantee:

• Accuracy: Automated transaction detection and categorization may contain errors. You are responsible for reviewing and verifying all financial information
• Completeness: Notification-based transaction detection may miss transactions or detect incomplete information
• Availability: The app and services (including backup and restore) may be unavailable due to maintenance, technical issues, or third-party service disruptions
• Data Integrity: While we implement reasonable measures, we do not guarantee that data will not be lost, corrupted, or altered due to technical issues, device failures, or third-party service problems
• Backup Success: Backup and restore features depend on Google Drive availability and your Google account status. We do not guarantee that backups will always succeed or that backup files will always be restorable

9.4 Data Loss

You acknowledge and agree that:

• Data loss may occur due to device failure, software bugs, user error, uninstallation, or other causes
• You are responsible for maintaining your own backups and verifying that backups are successful
• We are not liable for any data loss, regardless of cause
• The optional backup feature is provided as a convenience but does not guarantee data recovery

9.5 Limitation of Liability

10. Indemnification

You agree to indemnify, defend, and hold harmless Accie Technologies from any claims, damages, losses, liabilities, and expenses arising from your use or misuse of the App, your violation of these Terms, or your violation of applicable laws.

11. Data Deletion and Account Termination

11.1 Delete App Data (Keep Account)

You may delete your local app data while keeping your account by using the "Delete Data" or similar option in the app settings (if available). This will:

• Remove all locally stored financial data, transactions, budgets, goals, notes, and settings from your device
• Keep your account (email address) active in Firebase Authentication
• Allow you to continue using the app with the same account

Important: If you have created Google Drive backups, deleting local data does not delete backup files stored in your Google Drive. Backup files will remain in your Google Drive unless you delete them separately.

11.2 Delete Account

You may permanently delete your Fiby account by using the "Delete Account" option in app settings. Account deletion:

• Removes your account and authentication data from Firebase Authentication
• Signs you out of the app immediately
• Prevents you from signing in again with the deleted account
• Deletes local app data from your device
• Is permanent and cannot be undone

11.3 Uninstalling the App

Uninstalling the app from your device will remove the app and local data, but:

• Your account (if created) will remain active in Firebase Authentication
• Backup files in your Google Drive (if any) will remain
• You can reinstall the app and sign in with the same account to restore from backup (if available)

11.4 Termination by Accie Technologies

We reserve the right to suspend or terminate your account and access to the app if:

• You violate these Terms or our Privacy Policy
• You engage in fraudulent, abusive, or illegal activities
• We are required to do so by law or legal process
• We discontinue the app or service (with reasonable notice where feasible)

If we terminate your account, we will make reasonable efforts to notify you via email. Backup files in your Google Drive will not be deleted by us and remain under your control.

11.5 Effect of Termination

Upon termination of your account (whether by you or by us):

• Your right to use the app immediately ends
• Sections of these Terms that by their nature should survive termination will survive, including but not limited to: intellectual property rights, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution
• We are not liable for any loss or damage resulting from termination

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

12.2 Jurisdiction

You agree that any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.

12.3 Dispute Resolution Process

Before initiating formal legal proceedings, you agree to contact us at support[at]fiby.app to attempt informal resolution and allow us 45 days to respond.

12.4 No Class Action

You agree to resolve disputes individually and waive any right to participate in a class action or representative proceeding.

13. Miscellaneous Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Accie Technologies through Fiby app service. If any provision is found invalid, the remaining provisions continue in full force. We are not liable for failures due to circumstances beyond our reasonable control.

14. Specific Terms for India

We comply with all applicable Indian laws, including the Information Technology Act, 2000, IT (Intermediary Guidelines) Rules, 2021, and Consumer Protection Act, 2019. For grievances, contact us using the information in Section 15.
