1. Introduction and Acceptance

1.1 Agreement to Terms

Welcome to Fiby,a data entry and visualization application developed and owned by Accie Technologies. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Accie Technologies ("we," "us," or "our") governing your use of the Fiby mobile application (the "App") and related services.

1.2 Trademark and Ownership

"Fiby" is a trademark of Accie Technologies. Trademark registration has been filed and is pending approval. The Fiby name, logo, and all related intellectual property are the sole property of Accie Technologies. Unauthorized use, reproduction, or distribution of our trademark or intellectual property is strictly prohibited.

1.3 Amendments

We reserve the right to modify these Terms at any time. Material changes will be notified through the App or via email. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.

2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 18 years of age to use Fiby. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2.2 Account Types

Fiby offers two account types:

• Guest Account: Anonymous access with limited features and local data storage only
• Google Account: Full-featured account with cloud backup and synchronization

2.3 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account.

3. Description of Services

3.1 Core Features

Fiby provides the following services:

• Transaction Tracking: Automatic detection and categorization of financial transactions from notification data
• Expense Management: Organization and analysis of expenses and income
• Financial Insights: Reports, trends, and spending analytics
• Reminders: Alerts for bills, subscriptions, and recurring payments
• Multi-Currency Support: Support for multiple currencies and countries
• Data Backup: Optional cloud backup to user Google Drive account (if enabled)

4. User Obligations and Conduct

4.1 Permitted Use

You may use Fiby only for lawful purposes and to track your personal financial transactions, generate reports, and set reminders.

4.2 Prohibited Conduct

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to hack, reverse engineer, or decompile the App
• Use automated systems or bots to access the App
• Interfere with or disrupt the App's operation or servers
• Transmit viruses, malware, or harmful code
• Impersonate another person or entity
• Use the App for commercial purposes without our written consent
• Remove or modify any copyright, trademark, or proprietary notices

4.3 Data Accuracy

While we strive for accurate transaction categorization, you acknowledge that automated categorization may contain errors. You are responsible for verifying the accuracy of your financial data and should not rely solely on Fiby for important financial decisions.

5. Permissions and Data Access

5.1 Required Permissions

Fiby requires certain device permissions to function:

• Internet Access: For authentication and cloud sync
• Notification Access: To read transaction notifications (optional but required for core features)
• Biometric Access: For secure app authentication (optional)
• Alarm Permissions: For reminder notifications

5.2 Notification Listener Service

By granting notification access, you authorize Fiby to read notifications from banking/sms and financial apps, process transaction information, and categorize and store transaction data locally.

5.3 Data Privacy

Your data privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference.

6. Intellectual Property Rights

6.1 Ownership

All content, features, and functionality of the App, including software code, algorithms, user interface, design, trademarks, and transaction categorization logic, are owned by Accie Technologies and protected by intellectual property laws.

6.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device for personal, non-commercial purposes.

6.3 Restrictions

You may not copy, modify, create derivative works, sell, rent, lease, distribute, or use the App to develop a competing product.

6.4 Trademark Protection

"Fiby" and associated logos are trademarks of Accie Technologies (trademark registration pending). You may not use our trademarks without our prior written consent. Any unauthorized use may result in legal action.

7. Fees and Payments

7.1 Current Pricing

Fiby is currently offered free of charge for the basic version(beta). We may introduce premium features or subscription plans in the future.

7.2 Future Premium Features

If we introduce paid features, you will be notified in advance, existing free features will remain free, and pricing will be clearly displayed before purchase.

7.3 Subscription Terms(if applicable)

For any future premium subscriptions:

• Subscription auto-renew unless cancelled
• Billing occurs through your Google Play Store account
• Refunds are subject to Google Play Store policies
• You can cancel anytime through your Google Play Store settings

7.4 Third-Party Services

As the current version(beta) is free, no Refunds are applicable, if paid services are introduced in the future, our refund policy will be updated accordingly

8. Third-Party Services

8.1 Google Services

Fiby integrates with Google services, including Firebase Authentication, Firebase Analytics, Firebase Crashlytics, and Google Sign-In. Your use of these services is also governed by Google's Terms of Service and Privacy Policy.

8.2 Banking and Financial Apps

Fiby reads notifications from third-party banking and financial apps. We are not affiliated with, endorsed by, or responsible for these third-party services.

9. Disclaimers and Limitations of Liability

Fiby is a financial tracking tool, not a financial advisor. We do not provide investment advice, tax preparation services, legal or accounting services, or certified financial planning. You should consult qualified professionals for financial, tax, or legal advice.

9.3 No Guarantee of Accuracy

While we strive for accuracy in transaction categorization, automated categorization may contain errors. We do not guarantee 100% accuracy and are not liable for miscategorized transactions.

9.4 Limitation of Liability

10. Indemnification

You agree to indemnify, defend, and hold harmless Accie Technologies from any claims, damages, losses, liabilities, and expenses arising from your use or misuse of the App, your violation of these Terms, or your violation of applicable laws.

11. Termination

You may terminate your account at any time by uninstalling the App or deleting your account through App settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent activities.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

12.2 Jurisdiction

You agree that any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Hyderabad,India.

12.3 Dispute Resolution Process

Before initiating formal legal proceedings, you agree to contact us at support[at]fiby.app to attempt informal resolution and allow us 45 days to respond.

12.4 No Class Action

You agree to resolve disputes individually and waive any right to participate in a class action or representative proceeding.

13. Miscellaneous Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Accie Technologies through Fiby app service. If any provision is found invalid, the remaining provisions continue in full force. We are not liable for failures due to circumstances beyond our reasonable control.

14. Specific Terms for India

We comply with all applicable Indian laws, including the Information Technology Act, 2000, IT (Intermediary Guidelines) Rules, 2021, and Consumer Protection Act, 2019. For grievances, contact us using the information in Section 15.
